Terms of Service

These Terms govern your access to and use of the Traford Farm Fresh website at trafordfresh.today and our mobile app (together, the “Service”). By creating an account or placing an order you agree to be bound by these Terms.

1. About us

The Service is operated by Traford Farm Fresh, a company based in Kampala, Uganda. References to “we”, “us” and “our” mean Traford Farm Fresh. References to “you” mean the person using the Service.

2. Eligibility

  • You must be at least 18 years old to create an account or place an order.
  • You must provide accurate, current, and complete information.
  • You are responsible for keeping your account credentials confidential and for all activity that happens under your account.
  • If you suspect unauthorised access to your account, contact us immediately at trafordexport@gmail.com.

3. Orders and acceptance

  • Placing an order is an offer to buy the products listed at the prices and quantities shown.
  • An order is only accepted once we send you an order-confirmation message. Until then we may refuse the order for any reason, including unavailability of stock or suspected fraud.
  • We reserve the right to limit quantities, cancel orders that contain obvious pricing errors, and refuse service.
  • Where an item is out of stock after acceptance, we will contact you to offer a substitute, partial fulfilment, or a full refund of the unavailable item.

4. Prices, fees, and taxes

  • All prices are shown in Ugandan Shillings (UGX) and include applicable VAT unless otherwise stated.
  • A delivery fee may apply depending on your location; the fee is shown before you confirm the order.
  • Prices may change at any time, but changes will not affect orders that have already been accepted.

5. Payment

  • We accept mobile money, card payments, and cash on delivery (where available).
  • Card and mobile-money payments are processed by regulated third-party providers. We do not store full card numbers or mobile-money PINs.
  • If a payment fails, the order will not be processed until payment is received.
  • For cash on delivery, payment must be made in full to the delivery rider before the goods are handed over.

6. Delivery

  • We deliver within service zones listed on the Service. Coverage may change as we expand.
  • Estimated delivery times are best-effort and may be affected by traffic, weather, or other circumstances beyond our control.
  • You (or someone you authorise) must be available to receive the order at the address you provided. If we cannot deliver after a reasonable attempt, the order may be cancelled and a re-delivery fee may apply.
  • Risk of loss passes to you once the order is handed to you or your authorised recipient.

7. Quality, refunds, and returns

  • We are committed to delivering fresh, high-quality produce. If anything you receive is damaged, spoiled, or incorrect, contact us within 24 hours of delivery.
  • After review, we will at our discretion: replace the item, issue a credit to your account, or refund the affected portion of your order to the original payment method.
  • Refunds to mobile money or cards normally clear within 7 working days, subject to the payment provider's processing time.
  • Because most items are perishable, we cannot accept returns of opened or partially-consumed produce except where a defect is identified.

8. Cancellation

  • You may cancel an order any time before it is dispatched, at no cost.
  • Once an order has been dispatched it can no longer be cancelled — but you can still reject the delivery on quality grounds (see Section 7).
  • We may cancel an order at any time before delivery if we discover an error in pricing or stock, suspect fraud, or are unable to deliver to your location. In all such cases you will receive a full refund of any payment made.

9. Acceptable use

You agree not to:

  • Use the Service to break any applicable law or for any fraudulent purpose.
  • Interfere with, disrupt, or attempt to gain unauthorised access to the Service or its infrastructure.
  • Reverse engineer, scrape, or harvest data from the Service.
  • Impersonate any person, misrepresent your identity, or submit false information.
  • Use the Service to send spam, malware, or any content that is unlawful, threatening, defamatory, or otherwise harmful.

We may suspend or terminate your account immediately if we have a reasonable basis to believe you have breached these Terms.

10. Intellectual property

All content on the Service — including text, graphics, logos, images, software, and the “Traford Farm Fresh” name — is owned by Traford Farm Fresh or our licensors and is protected by Ugandan and international intellectual-property laws. You may not copy, modify, distribute, or create derivative works of any content on the Service without our prior written permission, except for personal, non-commercial viewing.

11. User-generated content

If you submit reviews, ratings, photos, or other content via the Service, you grant us a non-exclusive, worldwide, royalty-free licence to host and display that content as part of operating the Service. You confirm that the content is yours to share and does not violate any third-party rights. We may remove content that breaches these Terms.

12. Service availability

We work hard to keep the Service running, but we do not guarantee it will be uninterrupted or error-free. We may add features, change features, or take parts of the Service offline for maintenance at any time.

13. Disclaimers

Except as expressly stated in these Terms, the Service is provided “as is” and “as available”, without any warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

14. Limitation of liability

To the maximum extent permitted by Ugandan law, Traford Farm Fresh will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising out of or in connection with your use of the Service.

Our total liability to you for any claim arising out of or in connection with these Terms or the Service is limited to the amount you paid us for the order giving rise to the claim, or UGX 500,000, whichever is greater.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded under Ugandan law.

15. Indemnity

You agree to indemnify and hold Traford Farm Fresh harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.

16. Termination

  • You may close your account at any time by contacting us or using the in-app delete-account function.
  • We may suspend or terminate your account if you breach these Terms, if we are required to do so by law, or if we discontinue the Service.
  • Sections that by their nature should survive termination (e.g. intellectual property, liability, indemnity, governing law) will remain in effect.

17. Governing law and disputes

These Terms are governed by the laws of the Republic of Uganda. Any dispute that we cannot resolve amicably will be submitted to the exclusive jurisdiction of the courts of Uganda.

18. Changes to these Terms

We may update these Terms from time to time. If we make material changes we will notify you by email or via an in-app banner before the changes take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
